Situations can change and you may discover that you can no longer work with art71. Perhaps you discover you would like to run the website in-house? Or perhaps you wish to work with new technical partners? All art71 agreements can be broken with just ONE day's notice from you, the Client. art71 reserves the right to cancel the agreement with 30 (THIRTY) days' notice. We would rarely wish to cancel the contract but sometimes we are not happy to continue operating some types of website.

If you cancel the agreement, the website can not simply be moved to another web server. Your website is operated using software run by art71 and licensed to you. If you change suppliers, your new web company will have to duplicate the functionality of the site and, increasingly, this includes the creation of the actual web pages themselves.

What do you own as the Client?

As the Client who commissioned the website, you own:

  • All domain names.
  • All text content of the website.
  • The "look" and design of the site including all graphics. Copyright in photographic images taken by art71 while commissioned by you shall remain with art71 but the images will be licensed to you for a lifetime marketing use, regardless of who is running your website.
  • All files including videos, photographs, PDFs, Word documents and any other files which are downloadable by users.
  • All data associated with the website.
  • All logged data such as messages left by users.

What can not be transferred?

Increasingly, art71 websites are being operated by software which is hard-wired in to art71's server and can not be moved to a third party web company. The functionality of the website would therefore have to be duplicated by your new technical partners. This includes online forms which collect contact information, control pages which retrieve logged messages and orders, shopping cart systems and increasingly almost any web page which lists products. The data will be transferred in full to you. But the software which generates the pages themselves can not be transferred.

The technical section

If you are discussing changing contracts with new technical partners, here is a list of the files and data which will be transferred to you on cancellation of the contract:

  • Access to all your domain names.
  • All static HTML files, if your website has any.
  • All graphics, videos, photographs, PDFs, Word documents and any other files which are downloadable by users to the website.
  • All CSS style sheets.
  • All data which is used to generate web pages, for example, product listing databases. However, the software itself which reads the database and creates HTML pages is not transferable.
  • All data left by your users such as logged messages, orders, access logs etc.
  • Passwords where appropriate for Google accounts, Yahoo! marketing etc
